The aim of this paper is to evaluate the extent of the practice of using informal payments for accessing the services of public clinics or hospitals across Europe and to explain the prevalence of this corrupt practice using the framework of institutional theory. To achieve this, a multi-level mixed-effect logistic regression on 25,744 interviews undertaken in 2020 with patients across 27 European Union countries is conducted. The finding is that the practice of making informal payments remains a prevalent practice, although (...) there are large disparities in the usage of this practice in different European countries. However, informal payments by patients are more likely when there is a lower institutional trust and a higher degree of asymmetry between formal and informal institutions. The resultant proposal is that policy makers need to address the institutional environment to tackle such informal payments. How this can be achieved is outlined. (shrink)

The coordination of beliefs, norms, and behaviors is foundational to theories of group formation. However, because beliefs and norms are not directly observable, signaling mechanisms are required to build reliable signals of latent traits. Although the mathematical theory behind these signals is robust, there is very little testing of ethnic marker theory or of its key propositions that markers become more prevalent along ethnic boundaries and where more than two cultural groups are in contact. We present an ethnographic test of (...) this theory with phonetic differences serving as potential group signals. The data derive from an ethnographic and linguistic investigation in two contrasting secondary school settings in Utah, one that is majority European American and one that is ethnically more diverse. Word list recordings were collected as part of interviews with teens from different backgrounds. We extracted acoustic data from the speech of European Americans (EAs) and Pacific Islanders (PIs), then analyzed differences in the pronunciation of the vowel in words such as “bit.” We found evidence of greater phonetic marking at the more diverse school, along more prominent boundaries of ethnic interaction. These results align with predictions made by the theoretical models. This initial empirical test of model predictions provides justification for the development of more complex models that could account for more variables within the environment. (shrink)

Human cooperation is highly unusual. We live in large groups composed mostly of non-relatives. Evolutionists have proposed a number of explanations for this pattern, including cultural group selection and extensions of more general processes such as reciprocity, kin selection, and multi-level selection acting on genes. Evolutionary processes are consilient; they affect several different empirical domains, such as patterns of behavior and the proximal drivers of that behavior. In this target article, we sketch the evidence from five domains that bear on (...) the explanatory adequacy of cultural group selection and competing hypotheses to explain human cooperation. Does cultural transmission constitute an inheritance system that can evolve in a Darwinian fashion? Are the norms that underpin institutions among the cultural traits so transmitted? Do we observe sufficient variation at the level of groups of considerable size for group selection to be a plausible process? Do human groups compete, and do success and failure in competition depend upon cultural variation? Do we observe adaptations for cooperation in humans that most plausibly arose by cultural group selection? If the answer to one of these questions is “no,” then we must look to other hypotheses. We present evidence, including quantitative evidence, that the answer to all of the questions is “yes” and argue that we must take the cultural group selection hypothesis seriously. If culturally transmitted systems of rules (institutions) that limit individual deviance organize cooperation in human societies, then it is not clear that any extant alternative to cultural group selection can be a complete explanation. Trait emotional intelligence (“trait EI”) concerns our perceptions of our emotional abilities, that is, how good we believe we are in terms of understanding, regulating, and expressing emotions in order to adapt to our environment and maintain well-being. In this article, we present succinct summaries of selected findings from research on (a) the location of trait EI in personality factor space, (b) the biological underpinnings of the construct, (c) indicative applications in the areas of clinical, health, social, educational, organizational, and (...) developmental psychology, and (d) trait EI training. Findings to date suggest that individual differences in trait EI are a consistent predictor of human behavior across the life span. (shrink)

In addition to the discussion that follows variability of the concept of landscape and its relationship to the category of environment the contibution focuses on the specific problem of the current aesthetics: transformation of aesthetic reflection of the city as a whole, which is realized by the contemporary aesthetics and philosophy through the Kantian aesthetics in Critique of Aesthetics Judgement. Elaboration of opinions of Marie Rubene and Miroslav Marcelli leads us not only to summarize the (...) conclusions of recent theses, but further to reflect the transformation of city to a country, specific environment free from original effectiveness, where "human returns to natural and becomes a sort of huge subject, which is fluid in its inside..."). Animal data suggest that jet fuels such as JP-8 are associated with hearing deficits when combined with noise and that the effect is more pronounced than with noise exposure alone. Some studies suggest peripheral dysfunction while others suggest central auditory dysfunction. Human data are limited in this regard. The aim of this study was to investigate the possible chronic adverse effects of JP-8 combined with noise exposure on the peripheral and central auditory systems in humans. Fifty-seven participants who were current (...) personnel from the Royal Australian Air Force were selected. Based on their levels of exposure to jet fuels, participants were divided into three exposure groups. Groups were also categorised based on their noise exposure levels. All participants were evaluated by tympanometry, pure-tone audiometry, distortion product otoacoustic emissions, auditory brainstem response, words-in-noise, compressed speech, dichotic digit test, pitch pattern sequence test, duration pattern sequence test and adaptive test of temporal resolution. All auditory tests were carried out after the participants were away from the Air Force base for a minimum of two weeks, thus two weeks without jet fuel and noise exposure. Jet fuel exposure was significantly associated with hearing thresholds at 4 and 8 kHz; average hearing thresholds across frequencies in the better ear; DPOAEs at 2.8, 4 and 6 kHz; ABR wave V latency in the right ear; compressed speech and words-in-noise. Further analyses revealed that participants with low exposure level to jet fuels showed significantly better results for the aforementioned procedures than participants with moderate and high exposure levels. All results were controlled for the covariates of age and noise exposure levels. The results suggest that jet fuel exposure, when combined with noise exposure, has an adverse effect on audibility in humans. Taking all the test results into consideration, jet fuel exposure combined with noise exposure specifically seems to affect the peripheral hearing system in humans. (shrink)

In the Coman case, the European Court of Justice was asked whether the term “spouse”—for the purposes of EU law—includes the same-sex spouse of an EU citizen who has moved between EU Member States. The ECJ answered this question affirmatively, holding that a refusal to recognise a same-sex marriage and the resultant refusal to grant family reunification rights to a Union citizen who moves to another Member State, would constitute an unjustified restriction on the right to free movement that Union (...) citizens enjoy under EU law. This case comment analyses the judgment, arguing that the Court’s pronouncement is a very welcome first step towards marriage equality at a cross-border level in the EU. At the same time, following the delivery of this ruling, a lot of questions have arisen and gaps in the protection of same-sex couples persist, and these are also analysed in this piece. (shrink)

Why do many postpositivists caricature contemporary social science? Why make incorrect claims, for instance about social scientists avoiding values? Why discuss features that often no longer matter, such as seeking laws or predictions? Why reject extreme forms of social science without discussing more sensible forms? Why say little or nothing about scientific methodology, which is a great strength of recent social science? To explain such oversights and caricatures, philosophical analysis will not suffice. These are not isolated intellectual errors, but systematic (...) ones, made by numerous scholars and fostered by social practices and institutional conventions. We thus need ideological analysis, which specializes in explaining institutionalized systems of belief. Speculative explanations are offered for postpositivist caricatures, including not only psychological factors, but also external ones (for example, the arrogance of many social scientists), limitations of language (for example, the ambiguity of the term ‘methodology’), rhetorical strategies (for example, genealogical approaches), and conventions (for example, bad citation practices). This book develops a new conception of political economy at the interface of economic and political theory. Political economy is constituted by the interdependence between the economy and the polity that rest on the complex relations of society in which both are embedded. Effective policymaking depends on reflecting this embedding.

In this paper, we report the results of three high-powered replication studies in experimental philosophy, which bear on an alleged instability of folk philosophical intuitions: the purported susceptibility of epistemic intuitions about the Truetemp case (Lehrer, Theory of knowledge. Westview Press, Boulder, 1990) to order effects. Evidence for this susceptibility was first reported by Swain et al. (Philos Phenomenol Res 76(1):138–155, 2008); further evidence was then found in two studies by Wright (Cognition 115(3):491–503, 2010) and Weinberg et al. (Monist 95(2):200–222, (...) 2012). These empirical results have been quite influential in the recent metaphilosophical debate about the method of cases. However, none of Swain et al.’s ( 2008 ) predictions concerning order effects with Truetemp cases could be consistently and robustly replicated in our three experiments, and it is thus at best unclear whether Truetemp intuitions are in fact unstable. So, if proponents of the negative program in experimental philosophy still want to use order effects to challenge the reliability of philosophical case judgments, they would be well advised to look elsewhere instead. In any case, given the more robust empirical evidence that we present in this paper, the metaphilosophical flurry created by Swain et al. ( 2008 ) and Wright’s ( 2010 ) influential studies looks like mere alarmism in hindsight. (shrink)

Research on the legitimacy of multi-stakeholder initiatives (MSIs) continues to thrive, however, the vague distinction between descriptive and normative legitimacy seems to cause growing confusion. In our paper, we identify three problems in the literature on MSI legitimacy: lack of precision regarding which of the two forms is used; blurring of boundaries between them; and ambiguity of assessment when assessing MSI legitimacy with the help of fine-grained criteria. These three problems, we argue, are not only detrimental to construct clarity but (...) they can also lead to an erosion of normativity, by which we mean the increasing lack of normative grounding or (unintentional) deconstruction of the normative elements of legitimacy. We introduce a framework that addresses these three problems, ultimately demonstrating how scholars can use the concept of MSI legitimacy in a manner that enhances construct clarity and avoids erosion of normativity. The paper is thematically divided into two parts. In the first part, we will address the arguments raised against the anti-intellectualist thesis that ability is a necessary condition for knowledge-how, present Katherine Hawley’s proposed generic solution based on counterfactual success in order to overcome these arguments, followed by an analysis of Bengson & Moffett’s counterargument to Hawley’s counterfactual success thesis [CST]. We will conclude that Bengson & Moffett’s counterargument misses its target, so that, as far as we are concerned, Katherine (...) Hawley’s proposal, namely CST, is safe. In the second part of the paper, we will provide a statistical interpretation of one of Hawley’s more specific proposals, counterfactual success with occasional failure [CSTF], and assess a couple of philosophically challenging consequences that follow from such an interpretation. John McDowell's conception of perceptual knowledge commits him to the claim that if I perceive that P then I am in a position to know that I perceive that P. In the first part of this essay, I present some reasons to be suspicious of this claim - reasons which derive from a general argument against 'luminosity' - and suggest that McDowell can reject this claim, while holding on to almost all of the rest of his conception of perceptual knowledge, (...) by supplementing his existing disjunctive conception of experience with a new disjunctive conception of perceiving. In the second part of the essay, I present some reasons for thinking that one's justification, in cases of perceptual knowledge, consists not in the fact that one perceives that P but in the fact that one perceives such-and-such. I end by suggesting that the disjunctive conception of perceiving should be understood as a disjunctive conception of perceiving such-and-such. (shrink)

In attempting to explain the properties and behavior of an evolved artefact with the breathtaking complexity of the human brain, dissociating conventional causes and effects is like pulling apart an autosarcophagic snake. To paint a representative picture, we need a palette of explanatory languages capable of portraying the multifarious interactions within a complex system at suitable levels of abstraction. In particular, in addition to conventional causal explanations, the philosophy of science offers a framework of so-called constitutive explanations. Common philosophical accounts of creativity align creative products and processes with a particular kind of agency: namely, that deserving of praise or blame. Considering evolutionary examples, we explore two ways of denying that creativity requires forms of agency. First, we argue that decoupling creativity from praiseworthiness comes at little cost: accepting that evolutionary processes are non-agential, they nonetheless exhibit many of the same characteristics and value associated with creativity. Second, we develop a ‘product-first’ account of creativity by which a process (...) is creative just in case it gives rise to products deserving of certain forms of aesthetic engagement. (shrink)

_p_-Hacking, the use of analytic techniques that may lead to distorted research results, is widely condemned on epistemic and practical grounds. The prevalent position on this questionable research practice is that _p-_hacking should be avoided because it raises the probability of obtaining false-positive results, which can have harmful practical consequences. I have three aims in this paper. First, I offer a precise definition of _p-_hacking, something sorely needed in discussions of the practice. Second, I use philosophical tools from decision theory (...) to articulate the prevalent position on _p-_hacking and demonstrate its flaws. While _p-_hacking can have epistemic and practical costs, a more nuanced approach to its consequences is necessary. Third, I argue that there are scenarios in which _p-_hacking can be warranted. The prevalent position neglects key factors in its overall evaluation of the consequences of _p-_hacking. Moreover, it disregards considerations that can lend support to decisions about analytic choices that amount to _p-_hacking. One important, but often neglected consideration is that, while _p-_hacking may lead to more false-positives, it also increases the chances of uncovering true-positives. I appeal to non-epistemic judgments to defend the view that there are situations in which _p-_hacking may be warranted. (shrink)

Research risks have to meet minimal risk requirements in order for the research to qualify for expedited ethics review, to be exempted from ethics review, or to be granted consent waivers. The definition of “minimal risk” in the Common Rule (45 CFR 46) relies on the risks-of-daily-life and risks-of-routine-tests as comparators against which research activities are assessed to meet minimal risk requirements. While either or both comparators have been adopted by major ethics codes, they have also been criticized. In response (...) to criticisms, elaborations, and alternative comparators have been proposed. In this paper, I approach the search for workable comparators from the point of view that ethical reasoning about minimal risk involves analogical reasoning using comparators. In this regard, I develop two necessary conditions for an adequate minimal risk conception, which I use to assess three comparators. I conclude that the risks-of-routine-tests best fits the analogical reasoning operating in minimal risk assessments. (shrink)

The paper defends a compatibilist solution to the problem of the relationship between divine and human freedom. It is argued that the asymmetry of ability constituted by our ability to foreknowledge influence the future and our inability to control the past results from the asymmetry of openness between fixed past and open future interpreted in terms of the asymmetry of counterfactual dependence. Therefore, if the asymmetry of openness is not true of some types of facts, then we may be able (...) to control them even if they are facts about the past. It turns out that widely shared accounts of the nature and source of God’s foreknowledge entail that the asymmetry of openness does not apply to God’s past beliefs about future contingencies. Thus, it is unjustified to claim that we are unable to now do anything such that, if we were to do it, God’s past beliefs would have been different. (shrink)

Der folgende Aufsatz zielt darauf ab, Heideggers späte Sprachphänomenologie als eine Situationsontologie anzuerkennen. Es wird gezeigt, dass dieser Ansatz durch ein bisher unbeachtetes Relevanzproblem motiviert ist, das über das traditionelle Rahmenproblem hinausgeht. Das Relevanzproblem wird eingeführt und als ein neuartiger Schlüssel zum Verständnis von Heideggers Konzept der Sprache als „Zeigen“ eines involvierenden Kontexts vorgestellt. Es wird dabei dargelegt, wie sowohl repräsentationale als auch pragmatisch-enaktivistische Modelle der Sprache zu diesem Problem führen. Schließlich wird Heideggers radikal situative Konzeption von Sprache und Dinglichkeit (...) als eine Variante des Realismus klassifiziert, die als "Involvierender Realismus" bezeichnet werden kann und anderen zeitgenössischen Formen des Realismus wie dem Enaktiven Realismus oder dem Neuen Realismus kritisch gegenübergestellt wird.
